1. Acceptance of Terms

By accessing or using any product within The Insight System (“the Platform”), operated by RoBards Counseling & Consulting, Inc., you agree to be bound by these Terms of Service. If you do not agree, do not use the Platform.

2. Description of Services

The Insight System is a self-discovery platform that includes:

• The Insight Game — a personality typing card game based on Type-Temperament Theory
• Personality Reports — AI-generated reports for career, relationships, and personal growth
• Talking it Through — AI-guided couples assessments and coaching
• The Insight Journal — AI-powered journaling with personality-aware coaching

3. NOT THERAPY — Important Disclaimer

THE INSIGHT SYSTEM IS NOT A MENTAL HEALTH SERVICE, AND NOTHING ON THIS PLATFORM CONSTITUTES THERAPY, COUNSELING, DIAGNOSIS, OR CLINICAL ADVICE.

While our methodology draws on established psychological frameworks (including MBTI/Keirsey temperament theory, Gottman Method principles, attachment theory, and other research-based approaches), the Platform is an educational and informational tool designed for self-discovery and personal growth.

• AI-generated reports and coaching responses are not clinically validated
• Personality type results are for self-reflection, not clinical diagnosis
• Couples assessments and syntheses are educational, not therapeutic interventions
• Journal coaching is AI-generated and does not replace professional mental health support
• No therapist-client or counselor-client relationship is formed through use of this Platform

4. Accounts and Authentication

• You must provide a valid email address to create an account
• You are responsible for maintaining the security of your account
• You may not share your account credentials with others
• We may suspend or terminate accounts that violate these Terms

5. Subscription and Billing

5.1 Free Tier

Free accounts include access to The Insight Game, one personality report, limited journal entries, and one couples assessment topic.

5.2 Pro Subscription

The Pro subscription (pricing as displayed at checkout) unlocks unlimited access to individual products. Payment is processed by Stripe.

5.3 Couples Tier

The Couples tier (pricing as displayed at checkout) provides unlimited Talking it Through assessments and coaching for both partners, plus all individual Pro features.

5.4 Cancellation and Refunds

• You may cancel your subscription at any time through the billing portal
• Cancellation takes effect at the end of your current billing period
• We do not offer prorated refunds for partial billing periods
• After cancellation, your account reverts to the free tier

6. Couples Features — Consent and Conduct

• By inviting a partner to Talking it Through, you affirm that you have their informed consent
• Both partners must be 18 years or older
• AI-generated syntheses are shared between both partners
• We are not responsible for interpersonal conflicts that may arise from assessment results
• Either partner may leave a couple workspace at any time

7. Intellectual Property

7.1 Our Content

The Insight System, including the Type-Temperament Theory framework, assessment questions, temperament descriptions, and all associated content, is the intellectual property of RoBards Counseling & Consulting, Inc. and/or Dr. Martine J. RoBards. All rights reserved.

7.2 Your Content

You retain ownership of your journal entries, assessment responses, and other content you create. By using the Platform, you grant us a limited license to process this content as necessary to provide our services (including sending it to AI providers for report generation).

7.3 AI-Generated Content

AI-generated reports, syntheses, and coaching responses are provided for your personal use. You may share them, but you may not commercially redistribute AI-generated content from the Platform.

8. Acceptable Use

• Do not use the Platform to harass, abuse, or harm another person
• Do not attempt to reverse-engineer our AI prompts, scoring algorithms, or proprietary methodology
• Do not use automated tools to scrape or bulk-access the Platform
• Do not submit false or misleading information
• Do not use the Platform for any unlawful purpose

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ROBARDS COUNSELING & CONSULTING, INC. SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE PLATFORM.

Our total liability for any claim shall not exceed the amount you paid us in the 12 months preceding the claim. We provide the Platform “as is” and “as available” without warranties of any kind.

10. Indemnification

You agree to indemnify and hold harmless RoBards Counseling & Consulting, Inc., its officers, and employees from any claims arising from your use of the Platform or violation of these Terms.

11. Dispute Resolution

Any disputes arising from these Terms shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association. You waive your right to participate in class action lawsuits.

12. Governing Law

These Terms are governed by the laws of the State of California, without regard to conflict of law principles.
